Article 1: Intellectual property
In accordance with article 6 of the French law n°2004-575 of June 21, 2004 relating to confidence in the digital economy, users of ZetHeberge are informed of the identity of the various parties involved in its implementation and monitoring. These conditions define the terms under which ZetHeberge agrees to host its customers' digital services on its platform. The customer expressly acknowledges that ZetHeberge is not involved in the design, development, production and implementation of the customer's web site, the installation of the service or its administration.
Article 2: Acceptable use
As a user, you agree to use our site in a lawful manner and not to use it for any unlawful purpose, including, without limitation:
- Harass or abuse other users
- Infringe the rights of other users
- Violate the intellectual property rights of the site owners
- Pirate another user's account
- Acting fraudulently
- Host leaks or illegal content on our platforms
- Use of a VPS for cryptocurrency mining is strictly prohibited and may result in suspension of service.
- Participating in any illegal activity on the site
If we become aware of any illegal use or use that does not comply with the above conditions, we reserve the right to limit, suspend or terminate your access to the site, and to take all necessary legal action.
Article 3: Account
By creating an account on our site, you agree to be solely responsible for maintaining the security and confidentiality of your account, including all passwords and sensitive information associated with it, and for providing accurate and up-to-date personal information. You agree to update your information if it changes.
We reserve the right to suspend or terminate your account in the event of illegal use or non-compliance with the terms of use.
Article 4: Payment
We accept the following methods of payment on this site:
- Credit card
- PayPal
By providing your payment details, you confirm that you have authorized their use and access to the chosen payment instrument, and you authorize ZetHeberge to debit the amount due. In the event of non-compliance with any law or our terms and conditions, we reserve the right to cancel the transaction.
Article 5: Limitation of liability
ZetHeberge or its employees cannot be held responsible for any problems resulting from improper use of this site.
Article 6: Compensation
By using this site, you indemnify ZetHeberge from and against any and all liability, damages or expenses arising out of your use of or breach of these terms and conditions.
Article 7: Applicable laws
This document is subject to the laws applicable in France and aims to comply with its necessary rules and regulations. This includes the EU-wide regulations set out in the RGPD.
Article 8: Severability
If, at any time, any of the provisions set forth herein are found to be inconsistent with or invalid under applicable law, such provisions shall be deemed null and void and shall be removed from this document. All other provisions shall remain unaffected by such laws, and the remainder of this document shall continue to be considered valid.
Article 9: Right of withdrawal
In accordance with the provisions of article L.221-28 of the French Consumer Code, as ZetHeberge proceeds with the immediate execution of the service as of the validation of the order, the right of withdrawal cannot be exercised. If the service has not yet been implemented (in particular in the event of a service installation problem or stock shortage), this right of withdrawal must be exercised via the support available at the following address: https://espace.zetheberge.com or https://discord.gg/vzhfFcT9mJ, and entitles the User to reimbursement of sums already paid within thirty (30) days of receipt of the request. Any request for retraction which does not respect the legal time limit or the formalities set out in the previous paragraph will not be taken into consideration.
Article 10: Support and complaints
In the event of a problem or complaint, contact support via Discord, LiveChat or ticket. In the event of insults or harassment, ZetHeberge reserves the right to temporarily or permanently suspend your access to support.
Article 11: Payments and disputes
The customer agrees to contact ZetHeberge before opening a dispute with a payment company. A processing fee of 50€ may be charged in the event of a dispute, and ZetHeberge reserves the right to suspend access to services if the dispute is not resolved.
Article 12: Modification of services
ZetHeberge reserves the right to modify or terminate its services without notice for any reason. See refund policy for details.
Article 13: Non-compliance with the contract
ZetHeberge may suspend or terminate your services in the event of non-compliance with these conditions, without notice or formality, and without prejudice to damages.
Article 14: Contract amendment
ZetHeberge reserves the right to modify these conditions without prior notice. It is your responsibility to review these terms regularly. In the event of disagreement, your account and services may be terminated.
